The Jets refuse to comment on Kellen Winslow’s reported arrest other than calling it a ‘pending legal matter.’

Jets tight end Kellen Winslow Jr. was allegedly caught with synthetic marijuana on Nov. 19 in New Jersey and charged on Dec. 30, according to the Morristown Daily Record.

According to the Record, East Hanover police allegedly found Winslow in possession of Fubinaca, a synthetic marijuana, near a Target store on Route 10 in the New Jersey town.

“We are aware of the situation,” a team spokesperson said Thursday. “This is a pending legal matter, and we will have no comment.”

Winslow, 30, was suspended for four games earlier in the season for violating the league’s performance-enhancing drug policy. Following the suspension, Winslow was vague about what had triggered the suspension, saying only that he believed it to be allergy medicine. He did not specify what kind of allergies the medicine was for.

This latest incident allegedly occurred two days after Winslow returned to action against the Bills and eight days after being reinstated from the suspension.

According to the Record, Winslow is charged with possession of a controlled dangerous substance, a third-degree offense that could result in a maximum punishment of five years in prison. The report indicated that Winslow appeared in Morristown Superior Court on Wednesday for a processing hearing during which he received a copy of the complaints and evidence against him.

Winslow joined the Jets after a successful minicamp tryout before the season. He caught 31 passes for 388 yards and two touchdowns in 2013. He is a free agent and is not expected to return to the Jets.
